CBS BD-LIVE PRIVACY POLICY

CBS Corporation ("Company" or "we," "our," or "us") owns and operates CBS-BDLive.com ("Web Site") and individual Blu-ray Disc Sites for specific titles ("BD Sites"). The Web Site and BD Sites are collectively referred to as the "BD-Live Service". This Privacy Policy only applies to information collected by CBS when you register with and/or otherwise use or access the BD-Live Service (whether via personal computers, Blu-ray disc player, mobile devices or otherwise). This Privacy Policy does not cover any information collected offline or elsewhere by CBS (unless specifically stated).
The purpose of this Privacy Policy is to disclose to you the information we may collect through the BD: Live Service, how we may collect it, how we use that information and with whom we may share it.

1. What Types of Information does the BD-Live Service Collect?
Information You Provide To Us.
When you register and create an account with the BD-Live Service (either through an individual BD Site or the Web Site), we may ask you to provide us with certain categories of "Personal Information", which is information that could reasonably be used to identify you personally, such as your name, e-mail address, credit card number, and physical address. We may also ask you to provide "Demographic Information", such as gender, zip code, or similar information. We may collect Personal and Demographic Information through various forms and in various places on the BD-Live Service and may collect it through e-mail, Blu-Ray player, DVD player, mobile device or other technologies when you submit information, communicate, or otherwise interact with us. If we combine demographic or similar information with the Personal Information we collect, we will treat it as Personal Information under this Privacy Policy.
In addition, if you send someone else a communication from the BD-Live Service, such as if you choose to send a scene or other special feature, the information you provide (e.g., the other person's name, e-mail address, etc.) is used on a one-time basis to facilitate the communication and is not used for any other marketing purpose, unless we obtain consent from that person.
Information About You From Other Sources.
We may receive information about you from other sources and add it to the information that you provide to us through the BD-Live Service. For example, we may obtain information and combine it with information that you submit to us through the BD-Live Service. If we combine information we receive from those other sources with Personal Information we collect through the BD-Live Service, we will apply this Privacy Policy to any personal information received, unless we have disclosed otherwise.
2. Other Information Collected When You Visit the BD-Live Service
In addition to any Personal and Demographic Information or other information collected by the BD-Live Service, we and our third-party service providers may use a variety of technologies that automatically or passively collect certain information whenever you visit or interact with the BD-Live Service ("Usage Information"). This Usage Information may include your browser type, software client, operating system, the page served, the time of day, and the preceding page view, among other information. We may use Usage Information for a variety of purposes, including to enhance or otherwise improve the BD-Live Service. In addition, we may collect your IP address or some other unique identifier for the particular device you use to access the Internet, as applicable (collectively referred to as a “Device Identifier”). A Device Identifier is a number that is automatically assigned to your computer, your Blu-Ray player, or other device used to access the Internet, and our computers identify your device by its Device Identifier. Usage Information may be non-identifying or may be associated with you. Whenever we associate Usage information or Device Identifier with you, we will treated it as Personal Information. The methods that may be used to collect Usage Information include the following:
Cookies. Cookies are pieces of information that a server transfers and stores in your computer's or Blu-ray player's hard drive or memory when you access the BD-Live Service. Please note that most Blu-ray players utilize a “memory residing mechanism” as a form of cookies. Cookies may be used for many purposes, including, without limitation, tracking user preferences and web pages visited while using the BD-Live Service and/or to customize or update the functionality of your Blue-ray disc. Most browsers are initially set up to accept cookies. You may disable cookies using your browser or Blu-ray player's preferences, but some features of the BD-Live Service may not function properly or may operate slowly if you disable the cookies. For more information about cookies and how to disable them go to http://www.aboutcookies.org/Default.aspx?page=2 or consult with your Blu-ray player's manufacturer.
Web Beacons. Small graphic images or other web programming code called web beacons (also known as “1x1 GIFs” or “clear GIFs"), may be included in the BD-Live Service and e-mail messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the BD-Live Service, to monitor how users navigate the BD-Live Service, to count how many e-mails that were sent were actually opened or to count how many particular articles or links were actually viewed.
Mobile Device Identifiers. Certain mobile service providers uniquely identify mobile devices and we or our third-party service providers may receive such device information if you access the BD-Live Service through mobile devices. Certain features of our BD-Live Service may require collection of mobile phone numbers and we may associate that phone number to mobile device identification information. Additionally, some mobile phone service providers operate systems that pinpoint the physical location of devices that use their service. Depending on the provider, we or our third-party service providers may receive this information.
Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the BD-Live Service, such as which links you click on. The code is temporarily downloaded onto your computer or Blu-ray player from our web server or a third party service provider, is active only while you are connected to the BD-Live Service, and is deactivated or deleted thereafter.
3. Information You Disclose Publicly
If you register with the BD-Service and submit to the Site ideas, photographs, writings, music, video, audio recording, computer graphics, pictures, data, questions, comments, suggestions or other content, including Personal Information ("User Generated Content"), please exercise caution when deciding what information to include. It may be published online or offline in any media or format (currently existing or hereafter developed). Others may have access to this User Generated Content and may have the ability to share it with third parties across the Internet.
Please remember that any information about you which you disclose in this way becomes public information. CBS cannot ensure the security of any information you choose to make public through the User Content or otherwise through the BD-Live Service and cannot ensure that parties who have access to such publicly available information will respect your privacy. Public information is not subject to the restrictions in this Privacy Policy.
CBS may also publish your name, voice, likeness and other Personal Information with other User Generated Content (or any portion of the content), and CBS may use the content, or any portion of the content, for advertising, marketing, publicity and promotional activities. You may have the opportunity to engage in social networking through the BD-Live Service, such as creating a public profile, sharing photos and other information, and inviting others to connect with you. This Privacy Policy does not apply to any information that you disclose publicly or otherwise upload onto the BD-Live Service that you choose to disclose publicly or share with others. Please note that CBS does not control who will have access to the information that you choose to include in your public profile or share with others. Therefore, please think carefully before deciding what information you include in your public profile or otherwise make available to others. We are not responsible for the accuracy, use or misuse of any information that you disclose or receive through the BD-Live Service.
4. How Does Company Use the Information It Collects Pursuant to this Privacy Policy?
We use the various types of information we gather through the BD-Live Service for five (5) general purposes: (1) to fulfill your requests for certain products, services and information; to send you electronic newsletters or to provide you with special offers or promotional materials on behalf of us or third parties; and to enable you to participate in a variety of online features such as polls, sweepstakes, message boards, etc.; (2) to monitor or improve the BD-Live Service, to administer the BD-Live Service's systems and for other internal business purposes; (3) to enforce applicable BD-Live Service policies and meet other legal obligations; (4) for other reasons disclosed to you at the time you provide your Personal Information; and (5) to provide technical support, account updates and for other administrative purposes
5. How Does Company Share the Information?
We may share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the following circumstances:
Third Parties Providing Services on our Behalf. We may use third party vendors to perform certain services on behalf of the BD-Live Service, such as web site hosting and customer support, e-mail message deployment, suppression, merge and de-duplication services, data processing and to provide special products or services that you have requested. These third parties may have access to your Personal Information for the purpose of performing such functions on the BD-Live Service's behalf.
Sweepstakes, Contests and Promotions. We may offer sweepstakes, contests, and other promotions through the BD-Live Service that may require registration. If you choose to enter a sweepstakes, contest or other promotion, your Personal Information may be disclosed to third parties in connection with the administration of such promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law, such as on a winners list. Also, by entering a promotion, you are agreeing to the official rules that govern that promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing the sponsor(s) of the promotion to use your name, voice and/or likeness in advertising or marketing associated with the promotion.
Non-Personal Information. We may share certain use non-personal personal information], such as aggregate user data, with advertisers, business partners and other third parties.
Administrative and Legal Reasons. We may also transfer and disclose user information, including Personal and Demographic Information and Usage Information, to third parties: (i) in the event we are required to respond to subpoenas or other legal process or if in our good faith opinion such disclosure is required by law; (ii) at the request of governmental authorities conducting an investigation; or (iii) to protect and/or defend the BD-Live Service, its Terms of Use or other policies applicable to the BD-Live Service or to protect the personal safety, rights, property or security of any individual. We may also use IP address, Mobile Device Identifiers or other Device Identifiers to identify users, and may do so in cooperation with copyright owners, internet service providers, wireless service providers or law enforcement agencies in our discretion. Such disclosures may be carried out without notice to you.
Business Transfers. Company may share the information collected through the BD-Live Service with its subsidiaries and affiliates. Company also reserves the right to disclose and transfer all information relating to the BD-Live Service, including Personal Information: (i) to a subsequent owner, co-owner or operator of the BD-Live Service; or (ii) in a corporate merger, acquisition, consolidation, the sale of substantially all of its assets or other fundamental corporate change, whatever form it may take, provided such third party has agreed to use your Personal Information in accordance with protections that in all material respects are the same as or more protective than those set out in this Privacy Policy.
6. What are My Options?
The BD-Live Service may contain web pages through which you can edit the personal information you have provided to us through registration with one or more of the BD-Live Service, and which may allow you to change your marketing preferences. You may also opt-out of receiving future marketing communications or other communications to which you have subscribed by following the instructions contained in such e-mail messages when you receive them. Please note that if you maintain an account with the BD-Live Service, we reserve the right to send you certain communications relating to your account such as administrative and service announcements if they relate to your account, and these transactional account messages are not effected if you choose to opt-out from marketing e-mails. When you edit your personal information or change your preferences, information that you remove may persist internally for Company's administrative purposes. Also, if you have used any communication features of the BD-Live Service to publicly dislcose information, such as a blog or wiki board posting, these communications can not generally be removed.
7. Your Choices/Unsubscribe
You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of registration. To unsubscribe from receiving promotional material that you subscribed to through the BD-Live Service, follow the instructions provided at the end of an e-mail message or update your registration information at the BD-Live Service. Please be aware that we will process your request as quickly as we reasonably can, but it may not be possible to update our systems immediately.
In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.
8. A Note to Parents About the Privacy of Children
The BD-Live Service is for general audiences. We do not knowingly collect any Personal Information from children younger than the age of fourteen (14) on the BD-Live Service and we will delete any information later determined to be from a user younger than fourteen (14).
9. Third Party Content and Links to Other BD-Live Service
Our BD-Live Service may contain content that is supplied by a third party, and we may provide certain non-personally-identifiable information about the number of users that access the third party's content, or those third parties may directly collect web site usage information when web pages from a Web Site are served to your browser. In addition, when you are on the BD-Live Service you may be directed to other sites that are operated and controlled by third parties that we do not control. We are not responsible for the privacy practices employed by any of these third party sites. For example, if you "click" on a banner advertisement, the "click" may take you off the BD-Live Service onto a different web site. This includes links from advertisers, sponsors and partners that may use the BD-Live Service' logo as part of a co-branding agreement. These other web sites may send their own cookies to you, independently collect data or solicit personal information and may or may not have their own published privacy policies. If you visit a web site that is linked from our BD-Live Service, you should consult that web site's privacy policy before providing any personal information.
10. U.S. Law – Consent to Transfer
The BD-Live Service is hosted in and operated from Germany but is operated by CBS Corporation, a United States company. The operation of the BD-Live Service is governed by the laws of the United States. Please be aware that any Personal information you provide to us or we obtain as a result of your use of the BD-Live Service will be processed in Germany. By using and participating in any BD-Live Service and/or providing us with your Personal information, you consent to this collection, maintenance and processing of Personal Information in Germany in accordance with this Privacy Policy. We may also transfer your Personal Information to the United States and you consent to this transfer, storage and processing of your information in the United States in accordance with this Privacy Policy. The United States and Germany have different privacy laws that afford varying levels of protection for your Personal Information, and such laws may not be as comprehensive has those existing in your country of residence. If you do not consent to the collection, maintenance, processing and transfer of such information in and to Germany, the United States and other countries or territories, then you should not use the BD-Live Service.
11. Security
We incorporate commercially reasonable safeguards to help protect and secure your Personal Information. However, no data transmission over the Internet, or wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us via the BD-Live Service, and you do so at you own risk.
12. Changes to the Privacy Policy
By using the BD-Live Service, you acknowledge your agreement and consent to the terms of this Privacy Policy. We may change our Privacy Policy from time to time. Any modifications to our Privacy Policy will be reflected by the "Effective Date" or "Last Modified Date" on this Privacy Policy. Company will use your Personal Information in a manner consistent with the Privacy Policy in effect at the time you submitted the information, unless you consent to the new or revised policy.
13. Questions; Comments
Questions regarding this privacy statement should be sent to the "contact us" function (or similar feature) on the BD-Live Service. We may also file your comments to improve the BD-Live Service, or review and discard the information. Please note that information submitted to the BD-Live Service via a "contact us," or other similar mechanisms will not necessarily receive a response. We will not use any such information you provide to contact you for marketing purposes unrelated to your request.
